The Economic Court of Kyiv has ruled that the company "Kingsta" must return a land plot of 0.1 hectares to the Kyiv City Council, located in the Solomianskyi district. This was connected to the so-called "toilet scheme".
The decision was made on July 2.
In December 2024, the Kyiv City Council leased the plot to "Kingsta" for the construction and servicing of retail buildings at Adam Mickiewicz Street, 1-A.
This plot of land was granted without a competition because the company owns a public toilet building covering 104 square meters.
However, the prosecutor's office found that the Kyiv City Council violated the Land Code by transferring the land not for servicing the existing structure but for new construction.
Moreover, the transfer of land without a competition raised concerns since the area of the toilet is nearly 10 times smaller than the land parcel.
The court agreed with these arguments from the prosecutor's office, emphasizing that the property of 104 sq.m is a public toilet, whereas the Kyiv City Council's decision in question is for construction and servicing of commercial buildings.
As a result, the court declared the lease agreement for the 0.1-hectare plot invalid and ordered "Kingsta" to return the land to the community of Kyiv in a suitable condition for further use.
It is currently unclear whether the company will file an appeal.
Valentina Fedoruk is the owner and head of "Kingsta". From 2018 until April 2025, the director was Vitaliy Strashok.
According to the Kyivvlast publication, Valentina Fedoruk is associated with several prominent former officials and city council members.
She is a co-owner of "SO-5" and "SV-5" alongside Roman Blyumin, who has been or is still the head or official co-owner of several companies linked to the "Alexander Spasibko group"—a former deputy head of the Kyiv City State Administration responsible for land issues from 2016 to 2019.
These include companies such as "Vi-Pro", "Violta", "Valdi 2004", "Valdi-Holding", and "VK-48".
Blyumin is also a co-owner of "Marvi" together with city council member Olena Ovramenko.
Vitaliy Strashok is the chief accountant of the public organization "Obolon Legal Protection", co-founded by city council member Hanna Syvrydenko. Reports indicate that she and Ovramenko voted for the land allocation to "Kingsta".
"Toilet schemes" allow large land parcels to be allocated in Kyiv for small real estate objects.

The Economic Court of Kyiv also mandated "Apartbudgroup" to return a land plot of 0.15 hectares in the Pechersk district, also obtained through a "toilet scheme".
