New Law on Pre-Trial Investigations in Ukraine

Overview of the new law regarding pre-trial investigations of criminal offenses in Ukraine.

The official publication of the Verkhovna Rada, “Golos Ukrayiny,” recently reported the adoption of Law No. 4555-IX “On Amendments to the Criminal Procedure Code of Ukraine Regarding Pre-Trial Investigations of Crimes Related to Disappearances During Martial Law”.

According to the document, the law takes effect the day after its publication.

As reported, the Verkhovna Rada adopted a law on July 22 that reduces the powers of NABU and SAP.

In particular, Bill No. 12414 "On Amendments to the Criminal Procedure Code of Ukraine Regarding Pre-Trial Investigations of Crimes Related to Disappearances During Martial Law," underwent several amendments.

After the law's adoption, NABU Director Semen Kryvonos urged the President not to sign it, as it effectively places “two independent institutions – NABU and SAP – under dependency”.

President Volodymyr Zelensky signed the law on the peculiarities of pre-trial investigations regarding disappearances under martial law, which reduces the powers and independence of NABU and SAP.

Ukrainian lawmakers are initiating a signature collection and preparing a constitutional submission to the Constitutional Court of Ukraine regarding the law that restricts the powers of NABU and SAP.
